Legal Implications
All work is aligned to our responsibility under the Children and Young People (Scotland) Act 2014 and as always we will act with fairness, integrity and respect when carrying out these duties.
The introduction of The United Nations Convention on the Rights of the Child (Incorporation) (Scotland) Bill (UNCRC) into Scots law will have a significant influence on delivery of the priorities set out within ‘The Plan’. The ethos of UNCRC is consistent with the principles as it places the rights of children & young people at the heart of policy decision making and will provide a framework around which all children’s systems and services must operate.
The Children’s Care and Justice Bill proposes legislative reforms which seek to promote and advance the rights of children in the care and justice systems. This legislation seeks to redress the over representation of care leavers in the criminal justice system, aligning with the findings of the Independent Care Review, supporting the recommendations of The Promise, both of which informed the priorities set out within ‘The Plan’.
Both Bills are included within the current programme for Scottish Government.
