Response
The Scottish Police Authority has considered your request under the Freedom of Information (Scotland) Act (FOISA).
The decision has been reviewed by an independent reviewer who was not involved in the original decision-making process.
We can confirm that the original decision is upheld for the following reasons:
The Freedom of Information (Scotland) Act 2002 (FOISA) provides a right of access to recorded information. The Authority issued a refusal notice on 5 February 2025 in terms of section 25 of FOISA advising that the information requested is already publicly available.
That response referred to The Police and Fire Reform (Scotland) Act 2012 which established the Authority as a corporate body and sets out its functions.
To assist, the response also referred to other statutes relevant to the legislative framework within which the Authority operates (e.g. The Local Government etc (Scotland) Act 1994 and The Scotland Act 1998).
As the legislative provisions referenced in the original response are publicly available, we are satisfied that the Authority correctly issued a refusal notice in terms of section 25 of FOISA.
