Response
Your request is technically a Subject Access Request (SAR) and will therefore be considered in terms of the Data Protection Act 2018 / GDPR as explained on our website.
Our Information Management team will contact you separately in relation to your SAR.
Because you mentioned FOI in your request, we are required by law to provide this additional response in terms of the Freedom of Information (Scotland) Act 2002 (FOISA).
The Authority considers that to reveal whether the information exists or is held would be contrary to the public interest.
An individual’s own personal information is exempt from disclosure in terms of the Act under section 38(1)(a). Information disclosed under FOISA is disclosed into the public domain and the public interest overwhelmingly lies in protecting individuals’ right to privacy.
In terms of point 3 in your correspondence regarding case reference(s). The Scottish Police Authority does not hold the information requested.
