Report Summary
Issued 15 March 2023, this FOI response confirms that reporting on the recommendations set out in the Independent Review of Complaints Handling, Investigations and Misconduct Issues in Relation to Policing where there is an implementation role for the Authority and / or Police Scotland is publicly available. Advice is also provided that the Scottish Government are responsible for reporting progress on the implementation of all recommendations set out in the review.
Response
The Scottish Government is responsible for reporting progress on the implementation of all recommendations set out in the Independent Review of Complaints Handling, Investigations and Misconduct Issues in Relation to Policing. This reporting sets out steps made by all partner agencies, those being Police Scotland, Scottish Police Authority, Police Investigations & Review Commissioner, Crown Office & Procurator Fiscal Service and His Majesty’s Inspectorate of Constabulary in Scotland.
By way of assistance, we can advise that in December 2022 the Scottish Government published the latest Thematic Progress Report which includes an update on the public consultation on legislative proposals in relation to those recommendations which require legislative change.
In relation to those recommendations where an implementation role for the Authority and / or Police Scotland was identified, regular reporting to the Authority’s Complaints and Conduct Committee takes place and is publicly available on the Authority’s website. Therefore, this represents a notice in terms of Section 25 of the Freedom of Information (Scotland) Act 2002 - the authority considers that the information is already available, therefore there is no need to provide an alternative right of access to it through FOISA.
